Terms of Use

The Brazilian Portuguese (pt-BR) version is the authoritative legal text. This English translation is provided for convenience; in the event of any conflict, the Portuguese version prevails.
Welcome to nottepass. These Terms of Use ("Terms") govern your access to and use of the platform. By registering or using our services, you declare that you have read, understood, and fully agreed to these Terms.
The platform is operated by nottepass Tecnologia Ltda., enrolled under CNPJ No. 51.890.784/0001-01.
1. Definitions
- Platform / nottepass: the website, applications, and other interfaces operated by nottepass;
- Buyer / User: a natural person over 18 years of age who purchases Tickets or Products;
- Organizer: the individual or legal entity responsible for holding the Event and for its registration on the platform;
- Event: a party, show, performance, or any happening sold through the platform;
- Ticket: an entitlement to access an Event, linked to a unique QR Code;
- Product: a non-ticket item sold by the Organizer in the context of the Event (for example: drinks, food, combos, and merchandising), also represented by a unique QR Code or voucher;
- Service fee: the amount charged by nottepass for use of the platform, displayed transparently before the purchase is completed.
2. Nature of the service — nottepass is an intermediary
nottepass is NOT the Organizer of the Events nor the supplier of the Products. nottepass provides the technological infrastructure that allows Organizers to create, advertise, and sell Tickets and Products, and Buyers to acquire them, also acting as a facilitator of payment processing through a partner gateway.
As a result:
- The Organizer is solely responsible for holding the Event, for the delivery and quality of the Products, for the lineup, for the infrastructure and safety of the venue, for access conditions, and for compliance with licenses, permits, and other legal obligations related to the Event;
- Sales proceeds belong to the Organizer; nottepass merely intermediates the technology and the transfer of funds, less the Service fee;
- nottepass is not liable for cancellation, date changes, schedule changes, delays, unavailability of Products, quality, or frustrated expectations related to the Event;
- Complaints about the Event or the Products must be addressed directly to the Organizer.
3. Registration and account
3.1 Requirements
- Be at least 18 years of age and have full legal capacity;
- Provide true, complete, and up-to-date information;
- Keep your password confidential;
- Notify us immediately of any unauthorized use of the account.
3.2 Responsibility for the account
You are responsible for all activities carried out through your account. nottepass may suspend or terminate accounts that violate these Terms, with prior notice, except in urgent cases (fraud, unlawful acts, risk to third parties).
3.3 Accuracy of data
The User declares that the data provided is true and belongs to them, being civilly and criminally liable for false information or for the use of third-party data without authorization.
4. Purchases and payments
4.1 Purchase process
The purchase is completed after payment confirmation by the gateway. The QR Codes for Tickets and Products will be made available in your account and sent by email.
4.2 Price and fees
The price of each Ticket or Product is set by the Organizer. nottepass charges a Service fee, displayed transparently before the purchase is completed. The Service fee remunerates the use of the platform and is non-refundable in the event of a voluntary cancellation by the Buyer, except in the legal cases provided for in the Refund Policy (right of withdrawal within 7 days and cancellation of the Event by the Organizer).
4.3 Payment methods
We accept credit card and PIX, subject to availability at the time of purchase. We do not accept debit cards. Payment data is processed by the partner gateway and is not stored by nottepass in its full form.
4.4 Payment failures
In the event of refusal or payment failure, the order is automatically canceled and the Ticket or Product reservation is released. Repeated payment attempts may indicate suspected fraud and lead to suspension of the account for review.
4.5 Anti-fraud and chargeback
nottepass may cancel orders, Tickets, or Products upon indications of fraud. Filing a chargeback or an improper dispute, when access to the Event or the Product has already been enjoyed, constitutes unjust enrichment and may lead to suspension of the account and the recovery of the corresponding amounts and costs.
5. Cancellation and refund
The cancellation and refund rules are detailed in the Refund and Cancellation Policy. In summary:
- The Buyer may exercise the right of withdrawal within 7 days of purchase, pursuant to Article 49 of the Consumer Protection Code, provided the purchase was made online and the Event has not yet taken place — in which case the refund is full, including the Service fee;
- In the event of cancellation of the Event by the Organizer, the refund is full, including the Service fee, processed according to the payment gateway's timelines;
- In all other voluntary cancellations by the Buyer, the Service fee is non-refundable.
6. Tickets, Products, and access to the Event
- Each QR Code is unique, personal, and non-transferable;
- Each Ticket or Product is validated only once. The platform has a mechanism that prevents the reuse of the same QR Code: after the first validation, new attempts to use it are automatically refused;
- The Buyer is solely responsible for the safekeeping and secrecy of their QR Code. Sharing, public display, or transmission of the QR Code to third parties is the Buyer's exclusive responsibility — whoever presents the valid QR Code first may be granted access or have the Product redeemed, and the Buyer will not be entitled to a new entry, a new Product, or a refund;
- The resale of Tickets or Products by third parties (scalping) is prohibited and may result in cancellation of the Ticket or Product and of the account, without the right to a refund;
- Validation and redemption take place on-site by the Organizer. Decisions on admission, refusal of entry, and delivery of Products are the Organizer's responsibility;
- Products (drinks, food, combos, merchandising, and the like) are subject to availability and to the redemption conditions set by the Organizer. nottepass does not supply or deliver Products.
6.1 Third-party acquisition and transfers
The Ticket and the Product are non-transferable, and nottepass does not recognize, intermediate, or guarantee any transfer, donation, or resale carried out outside the platform. As a result:
- nottepass does not sell to anyone without a registered account. Purchases made directly between individuals, outside the platform, do not create any contractual or consumer relationship between nottepass and the acquirer — any complaint must be addressed to whoever made the sale;
- Anyone who receives or acquires a Ticket, Product, or QR Code from a third party is bound by these Terms by the mere act of using it and acquires, as against nottepass, no rights beyond those of the original Buyer. Any dispute over the acquisition is resolved exclusively between the acquirer and the person who transferred it;
- The original Buyer remains nottepass's sole counterparty and is liable for the consequences of any transfer they make;
- Tickets or Products identified as transferred or resold in breach of these Terms may be canceled, without the right to a refund.
7. User conduct
The following is prohibited:
- Using the platform for unlawful or fraudulent purposes or in ways that violate the rights of third parties;
- Attempting to access other users' accounts, restricted areas, or protected data;
- Performing reverse engineering, mass scraping, denial-of-service attacks, or any act that compromises the security of the platform;
- Registering false or third-party data;
- Using bots, automated scripts, or multiple accounts to circumvent purchase limits;
- Reselling Tickets or Products commercially without the Organizer's authorization.
Violation of these rules may result in cancellation of the account, loss of Tickets and Products without a refund, and civil and criminal liability under the law.
8. Intellectual property
All content on the platform — including the brand, logo, layout, source code, texts, and graphics — is owned by nottepass or its licensors and is protected by intellectual property law. Reproduction without prior and express authorization is prohibited.
9. Privacy and data protection
The processing of personal data complies with Law No. 13.709/2018 (General Data Protection Law – LGPD) and is detailed in the Privacy Policy. By using the platform, you acknowledge and accept the data processing practices described therein. In particular, when purchasing Tickets or Products, you are aware that your name, email, and phone number (when provided) are shared with the Organizer of the respective Event, for access validation and communication about the Event.
10. Availability and limitation of liability
The platform is provided "as is," without a guarantee of uninterrupted or error-free operation. Without prejudice to the provisions of the Consumer Protection Code, nottepass's liability is limited to the intermediation services actually provided. nottepass is not liable for:
- Damages arising from fortuitous events or force majeure;
- Temporary unavailability of third-party services (gateway, email, infrastructure) or scheduled maintenance;
- The conduct of Organizers or other users;
- The Organizer's decisions on admission, expulsion, delivery of Products, or conditions of participation in the Event;
- Content or services of third-party sites and integrations;
- Loss of profits, indirect damages, or loss of opportunity.
Where nottepass's liability is recognized, and except for the legal guarantees ensured by the Consumer Protection Code, it shall be limited to the amount of the Service fee actually received by nottepass in the transaction giving rise to the damage.
11. Indemnification
The User agrees to indemnify and hold nottepass harmless from any losses, damages, costs, and expenses, including attorneys' fees, arising from improper use of the platform, fraud, breach of these Terms, or violation of the rights of third parties. The Buyer also indemnifies nottepass against third-party claims by anyone to whom they have assigned, transferred, or resold Tickets or Products.
12. Support
Customer service is available through our Support Center, with a response time of up to 24 hours for ordinary requests. Formal complaints may be filed through the same channel.
13. Changes to the Terms
nottepass may update these Terms at any time. Material changes will be communicated at least 30 days in advance and will require a new expression of consent from the user to continue using the platform. The version history is available upon request.
14. Electronic communications and acceptance
Electronic acceptance of these Terms and communications made by email or through the platform have full legal validity. The record of acceptance — including date, time, IP address, and device identification — serves as proof of the User's expression of will. Mere use of the platform, as well as the use or presentation of a Ticket, Product, or QR Code — even by a person without a registered account — implies full acceptance of these Terms.
15. General provisions
- The invalidation of any clause of these Terms does not affect the others;
- nottepass's tolerance of any non-compliance does not constitute novation or waiver of rights;
- Assignment of these Terms by the user to third parties is prohibited.
16. Jurisdiction and applicable law
These Terms are governed by Brazilian law. The courts of the district of Presidente Prudente, State of São Paulo, are elected to settle any disputes, with express waiver of any other, however privileged, save for the consumer's right to choose the courts of their domicile (Article 101, I, of the Consumer Protection Code).
